Terms of Use for Rhythm
Last updated: 26 September 2026
These Terms of Use ("Terms") govern your access to and use of the Rhythm iOS application and related services ("Rhythm," the "App," "we," "us," or "our"), operated by Bakir Šuvalija.
By downloading, accessing, creating an account for, purchasing a subscription through, or using Rhythm, you agree to these Terms. If you do not agree to these Terms, do not use Rhythm.
Your use of the iOS application is also subject to the applicable Apple App Store terms, including Apple's standard Licensed Application End User License Agreement ("Apple Standard EULA"), except to the extent another applicable agreement governs your license to the App. These Terms govern Rhythm's service, accounts, subscriptions, features, and your relationship with us and supplement applicable Apple terms.
Our Privacy Policy explains how information is handled when you use Rhythm.
1. Eligibility
Rhythm is intended for a general audience and is not directed to children under 13.
You must be at least 13 years old to create or use a Rhythm account. If the law where you live requires you to be older in order to enter into these Terms or use particular features without permission from a parent or legal guardian, you may use Rhythm only if those requirements are satisfied.
You may not use Rhythm if applicable law prohibits you from receiving or using the App or its services.
2. Rhythm Accounts
Some Rhythm features require an account.
You may authenticate using supported methods such as email one-time codes, Sign in with Apple, or Google Sign-In.
You are responsible for maintaining control of the email address, Apple account, Google account, device, and other credentials or authentication methods associated with your Rhythm account. You must not knowingly allow another person to impersonate you or misuse your account.
You agree to provide accurate information where Rhythm requires information from you and to keep information necessary for your account reasonably current.
If you believe someone has gained unauthorized access to your Rhythm account, contact hello@rhythmlabs.app.
We may restrict or suspend access to an account where reasonably necessary to protect Rhythm, its users, our service providers, or others from fraud, abuse, security threats, unlawful activity, or material violations of these Terms.
3. Alarm Functionality and User Responsibility
Rhythm is designed to help you schedule and respond to alarms. Alarm functionality depends on your device, iOS, Apple system frameworks, device configuration, authorization status, software state, hardware, power, volume and audio behavior, and other circumstances that may be outside Rhythm's control.
You are responsible for:
- setting the intended alarm time and recurrence;
- checking that an alarm has been created and enabled correctly;
- maintaining a sufficiently charged and functioning device;
- keeping required system permissions or authorizations enabled;
- maintaining device settings reasonably necessary for the alarm to
- testing Rhythm before relying on it for an important event; and
- maintaining an appropriate backup or alternative alarm where failure
operate;
to wake could cause significant harm or loss.
Rhythm is a consumer alarm application. Do not use Rhythm as the sole alarm, warning, monitoring, emergency, medical, safety-critical, or life-critical system where failure, delay, device malfunction, software malfunction, or user error could result in death, personal injury, significant property damage, or another serious consequence.
We work to make Rhythm reliable, but no software, device, operating system, or alarm-delivery mechanism can be guaranteed to operate without interruption or failure.
4. Wake Challenges
Rhythm may offer wake challenges intended to make dismissing or completing an alarm more deliberate.
Challenge availability, configuration, difficulty, behavior, and presentation may change as Rhythm evolves. You are responsible for selecting settings appropriate for you.
Do not interact with Rhythm challenges when doing so would be unsafe, including while driving, operating machinery, or performing another activity requiring your full attention.
Wake challenges are not medical, sleep, cognitive, or health assessments and should not be interpreted as such.
5. Free Service and Advertising
Rhythm may be downloaded and used without an Ad-Free subscription. The free version may display advertisements, including banner and interstitial advertisements.
Advertising is provided through third-party advertising services such as Google AdMob. The availability and type of advertisements may depend on your region, device, privacy choices, applicable law, and advertising-service availability.
Where required, Rhythm may present consent or privacy controls before requesting advertisements. Additional information about advertising and associated information processing is provided in our Privacy Policy.
We may change reasonable advertising placements, frequency, formats, providers, or implementation as Rhythm evolves, subject to applicable law and App Store requirements.
6. Ad-Free Subscription
Rhythm offers an optional Ad-Free monthly auto-renewable subscription through Apple's App Store.
The subscription removes Rhythm's in-app advertising while you have an active Ad-Free entitlement. It does not remove third-party privacy interfaces or processing that may still be required to maintain privacy choices, verify entitlement state, prevent abuse, or comply with law.
6.1 Price
The current intended U.S. price for the monthly Ad-Free subscription is US\$1.99 per month. The actual price presented to you in the App and App Store may be localized by Apple and may differ by country or region, currency, tax treatment, or later pricing changes.
The price and billing terms shown by Apple at the time you confirm a purchase control the transaction.
6.2 Billing and renewal
Payment is charged through your Apple Account using Apple's in-app purchase system.
The subscription automatically renews for successive monthly periods unless you cancel it in accordance with Apple's subscription-management rules before renewal. Apple controls billing, renewal timing, payment processing, applicable taxes, and transaction handling.
You can manage or cancel the subscription through your Apple subscription settings.
Deleting your Rhythm account or deleting the App does not automatically cancel an App Store subscription.
6.3 Restoring purchases
Where supported, Rhythm provides a mechanism to restore eligible App Store purchases. Restored entitlement depends on Apple's transaction and entitlement records.
6.4 Price changes
Subscription prices may change in the future. Any price change will be handled through Apple's applicable subscription processes, notices, consent requirements, and App Store rules.
6.5 Refunds
Purchases are processed by Apple. Refund requests for App Store purchases are generally handled through Apple and are subject to Apple's applicable policies and mandatory consumer rights.
Nothing in these Terms limits any refund or consumer right that cannot lawfully be limited.
7. Account Deletion
Rhythm provides in-app functionality for deleting your Rhythm account.
Successful account deletion removes the applicable Rhythm authentication account and associated active Rhythm profile information from our account system and performs the local cleanup described in our Privacy Policy.
Account deletion does not automatically cancel your Apple subscription. If you have an active Ad-Free subscription and no longer want it to renew, you must manage or cancel that subscription through Apple.
Account deletion also does not necessarily erase information independently retained by Apple or third-party service providers where they have their own lawful retention requirements or systems. See the Privacy Policy for details.
8. Acceptable Use
You may use Rhythm only for lawful purposes and in accordance with these Terms.
You must not:
- use Rhythm in violation of applicable law or regulation;
- attempt to gain unauthorized access to Rhythm systems, accounts,
- interfere with, overload, damage, disrupt, or circumvent the
- probe, scan, or test vulnerabilities without authorization;
- use automated means to abuse account creation, authentication,
- submit malicious code, harmful content, or fraudulent requests;
- impersonate another person or misrepresent your authorization to act
- manipulate purchases, entitlements, advertisements, analytics,
- use Rhythm to infringe the rights of another person;
- resell, sublicense, rent, or commercially exploit access to Rhythm
- copy, modify, reverse engineer, decompile, disassemble, or attempt
infrastructure, APIs, or service-provider systems;
operation or security of Rhythm;
advertising, subscriptions, or other App functionality;
for another person;
authentication, or account-deletion mechanisms;
except where expressly permitted by us or applicable law; or
to derive source code from Rhythm except to the extent such a restriction is prohibited by applicable law or permitted by applicable open-source licenses.
We may take reasonable technical or account-level measures to prevent or respond to misuse.
9. License and Ownership
Rhythm and its original software, design, branding, graphics, interfaces, documentation, and other original materials are owned by Bakir Šuvalija or used under applicable licenses and are protected by intellectual-property laws.
Subject to these Terms, the applicable Apple terms, and your compliance with them, you receive a limited, personal, non-exclusive, non-transferable right to use Rhythm on Apple devices you own or control as permitted by the App Store usage rules.
Rhythm is licensed, not sold. No ownership interest in Rhythm or its intellectual property is transferred to you.
Third-party software and services included in or used by Rhythm remain subject to their respective licenses and terms.
10. Feedback
If you voluntarily send us ideas, suggestions, bug reports, feature requests, or other feedback about Rhythm, you give us permission to use that feedback without restriction or compensation to improve, develop, operate, or promote Rhythm.
This does not transfer ownership of material that you independently own beyond the rights reasonably necessary for us to use the feedback you voluntarily provide.
11. Third-Party Services
Rhythm relies on or interoperates with third-party platforms and services, including Apple services, Supabase, Resend, PostHog, Google services, and advertising services.
Your use of third-party services may also be governed by their own terms and policies. You are responsible for complying with applicable third-party terms when using Rhythm.
We do not control third-party platforms and cannot guarantee that they will always remain available, unchanged, or compatible with Rhythm.
If a third-party service changes, restricts, suspends, or discontinues functionality, we may need to modify, suspend, or discontinue affected Rhythm functionality.
12. Updates and Changes to Rhythm
We may update Rhythm from time to time to add, remove, modify, improve, secure, or repair features.
Features may evolve between versions. We do not promise that every feature, design, integration, advertisement format, challenge, or third-party service will remain available indefinitely.
Some updates may be necessary for security, compatibility, legal compliance, App Store requirements, or continued operation.
Where required by applicable law, material changes affecting paid services or user rights will be handled with appropriate notice or other required measures.
13. Availability
We aim to provide a reliable service, but Rhythm may occasionally be unavailable, delayed, interrupted, limited, or affected by circumstances outside our control.
These circumstances may include device or operating-system behavior, Apple services, internet connectivity, third-party outages, maintenance, software defects, security incidents, regulatory requirements, or changes to third-party APIs and services.
We may suspend all or part of Rhythm where reasonably necessary for maintenance, security, legal compliance, protection of users or systems, or circumstances beyond our reasonable control.
14. Privacy
Our Privacy Policy explains how information is processed in connection with Rhythm and forms an important part of your use of the service.
By using Rhythm, you acknowledge that you have been provided access to the Privacy Policy. Where consent is legally required for particular processing, we will request that consent separately rather than treating acceptance of these Terms as consent.
15. No Medical or Professional Advice
Rhythm is an alarm and productivity utility. It does not provide medical advice, diagnosis, treatment, sleep medicine, emergency monitoring, or other professional advice.
Any alarm, wake challenge, timing feature, statistic, or other App output is provided as a software feature and should not be treated as a medical or professional determination.
If you have concerns about sleep, health, medication, or another medical issue, seek advice from an appropriately qualified professional.
16. Disclaimers
To the maximum extent permitted by applicable law, Rhythm is provided on an "as is" and "as available" basis.
We do not guarantee that Rhythm will be uninterrupted, error-free, completely secure, compatible with every device or future iOS version, or that every alarm will trigger, sound, wake you, or be delivered exactly as expected.
We disclaim warranties to the extent they may lawfully be disclaimed, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
However, some jurisdictions do not allow certain warranty exclusions. Nothing in these Terms excludes or limits warranties, statutory guarantees, or consumer rights that cannot lawfully be excluded or limited.
17. Limitation of Liability
To the maximum extent permitted by applicable law, Bakir Šuvalija will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business opportunity, goodwill, or data, arising from or relating to your use of or inability to use Rhythm.
To the maximum extent permitted by applicable law, we are not responsible for losses caused by circumstances outside our reasonable control, including device failure, operating-system behavior, disabled permissions, insufficient battery power, muted or altered audio behavior, third-party outages, network failures, or incorrect alarm configuration.
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability that cannot be excluded under applicable consumer-protection law.
Because laws differ between jurisdictions, some exclusions or limitations in this section may not apply to you.
18. Indemnity
To the extent permitted by applicable law, if your unlawful misuse of Rhythm or material violation of these Terms causes a third-party claim against us, you agree to be responsible for the reasonable losses, liabilities, and costs directly resulting from that claim.
This section does not require a consumer to indemnify us where such an obligation would be prohibited or unenforceable under applicable law.
19. Suspension and Termination
You may stop using Rhythm at any time. You may delete your Rhythm account using the in-app deletion functionality.
We may suspend or terminate access to Rhythm or an account where reasonably necessary because of:
- material or repeated violation of these Terms;
- fraud, abuse, or attempted circumvention of App functionality;
- security threats;
- unlawful activity;
- a legal or regulatory requirement; or
- discontinuation of the relevant service.
Where reasonably practicable and legally appropriate, we will seek to use proportionate measures.
Termination of your Rhythm account does not itself cancel an Apple subscription. You remain responsible for managing subscription renewal through Apple.
Sections that by their nature should survive termination, including provisions concerning ownership, disclaimers, limitations of liability, disputes, and accrued obligations, will survive as applicable.
20. Changes to These Terms
We may update these Terms when Rhythm changes, when our business or service providers change, or when legal or regulatory requirements require an update.
We will update the "Last updated" date when these Terms change.
If a change materially affects your rights or obligations and applicable law requires additional notice or consent, we will provide it.
Your continued use of Rhythm after updated Terms become effective constitutes acceptance to the extent permitted by applicable law. If you do not agree to updated Terms, you should stop using Rhythm and, where appropriate, delete your account and separately manage any active Apple subscription.
21. Governing Rules and Disputes
These Terms are intended to operate consistently with applicable law and with mandatory consumer protections in the country or region where you reside.
Nothing in these Terms deprives you of mandatory rights or protections that apply to you under applicable consumer law, including rights concerning the courts or dispute-resolution mechanisms available to you where those rights cannot lawfully be waived.
Before beginning formal proceedings, we encourage you to contact hello@rhythmlabs.app so that we can try to resolve the issue directly. This does not prevent you from exercising a right to bring a claim, contact a regulator, use a legally available dispute-resolution mechanism, or seek urgent relief.
These Terms do not impose mandatory arbitration, waive class-action rights, or select a foreign court or foreign governing law where doing so would conflict with mandatory rights applicable to you.
22. Export and Legal Compliance
You may use Rhythm only where your use is lawful.
You must comply with applicable export-control, sanctions, and trade laws. You may not use or access Rhythm where doing so would cause you or us to violate applicable legal restrictions.
Availability of Rhythm through an App Store storefront does not constitute a representation that every feature is lawful or appropriate for every person or circumstance.
23. Apple App Store
Rhythm is distributed through Apple's App Store. Your acquisition and use of the iOS application are subject to applicable Apple terms, including the Apple Standard EULA and App Store usage rules.
Apple is responsible for the App Store platform, purchase processing, and Apple-controlled services. Rhythm's operator, not Apple, is responsible for Rhythm's own service, content, and support to the extent required by applicable law and the agreements governing distribution through the App Store.
Apple has no obligation to provide maintenance or support for Rhythm beyond obligations Apple independently assumes for its own services.
Questions, complaints, or claims concerning Rhythm itself should be directed to hello@rhythmlabs.app.
24. Severability
If a provision of these Terms is found unlawful, invalid, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary to make it enforceable where permitted. If it cannot be made enforceable, it will be severed.
The remaining provisions will continue in effect unless applicable law requires otherwise.
25. No Waiver
If we do not immediately enforce a provision of these Terms, that does not waive our right to enforce it later.
A waiver is effective only to the extent expressly given and permitted by applicable law.
26. Entire Agreement
These Terms, together with the Privacy Policy and applicable Apple terms governing your license and App Store transactions, constitute the agreement governing your use of Rhythm with respect to the matters they cover.
If there is a conflict between these Terms and mandatory applicable law, mandatory law controls. If there is a conflict concerning an Apple-controlled transaction or App Store usage rule, the applicable Apple terms govern that Apple-controlled matter.
